Holiday OUI Season in Massachusetts: When a Drunk Driver Hits a Rider

Holiday OUI Season in Massachusetts: When a Drunk Driver Hits a Rider

Massachusetts Law
Scheduled to publish December 2, 2026

From Thanksgiving through New Year's, the roads around Boston fill with office parties, bar crawls, and drivers who had one too many before pointing the car home. The Southeast Expressway backs up, the O'Neill Tunnel gets sloppy, and Route 128 turns rough after last call. When an impaired driver drifts into your lane and puts you down, you are a rider with real injuries and no easy road back.

Quick answer: A drunk driver's fault is powerful evidence for your civil claim, Massachusetts Dram Shop law can reach the bar that overserved him, and your own UM coverage backs you up if he carries too little or flees. Massachusetts PIP does not cover motorcyclists, so proving fault is everything.

A drunk driver's fault makes your claim stronger

Your injury claim is a separate track from the criminal OUI case, but the two feed each other. An arrest, charge, or conviction for operating under the influence is powerful evidence that the driver breached their duty to drive safely. Insurers love to pin blame on the rider, arguing you were speeding, splitting, or hard to see. A documented OUI flips that story, because it is very hard to convince anyone the sober rider caused the crash when the other driver blew over the limit.

Massachusetts Dram Shop law can reach the bar

Sometimes the drunk driver is not the only one who put you in the hospital. Under Massachusetts Dram Shop principles, a bar, restaurant, or club that serves alcohol to a person who is already visibly intoxicated can share liability for the harm that person then causes. If the driver who hit you on Storrow Drive got pushed past the line by a bartender who kept the drinks coming, that establishment may be on the hook too, and it usually carries far larger coverage than an individual. Receipts, server records, and surveillance video vanish fast, so moving early is not optional.

When the OUI driver has low coverage or runs

Two ugly scenarios show up every December. The driver carries only the Massachusetts minimum of 20/40/5, which a single surgery blows past, or the driver panics and flees. Both are exactly what your own uninsured and underinsured motorist coverage is built for. Massachusetts requires UM at 20/40, and it is a rider's real backstop in a city full of uninsured and hit-and-run drivers. These claims are made against your own carrier, and your own carrier is not automatically on your side.
