From Thanksgiving through New Year's, the roads around Portland fill with office parties, bar crawls, and drivers who had one too many before pointing the car home. I-5 backs up through the Terwilliger curves, the ramps onto I-405 get sloppy, and US-26 the Sunset Highway turns rough after last call. A drunk driver's fault makes your claim stronger

Your injury claim is a separate track from the criminal DUII case, but the two feed each other. An arrest, charge, or conviction for driving under the influence of intoxicants is powerful evidence that the driver breached their duty to drive safely. Insurers love to pin blame on the rider, arguing you were speeding, splitting, or hard to see. A documented DUII flips that story, because it is very hard to convince anyone the sober rider caused the crash when the other driver blew over the limit.

Oregon's dram shop law can reach the bar

Sometimes the drunk driver is not the only one who put you in the hospital. Under Oregon's dram shop law, ORS 471.565, a bar, restaurant, or club that serves alcohol to a person who is already visibly intoxicated can share liability for the harm that person then causes. If the driver who hit you on Naito Parkway got pushed past the line by a bartender who kept the drinks coming, that establishment may be on the hook too, and it usually carries far larger coverage than an individual. Receipts, server records, and surveillance video vanish fast, so moving early is not optional.

When the DUII driver has low coverage or runs

Two ugly scenarios show up every December. The driver carries only the Oregon minimum of 25/50/20, which a single surgery blows past, or the driver panics and flees. Both are exactly what your own uninsured and underinsured motorist coverage is built for. Oregon requires UM and UIM, and it is a rider's real backstop in a metro full of uninsured and hit-and-run drivers. These claims are made against your own carrier, and your own carrier is not automatically on your side.
